How should I handle NDAs?

Posted 6 months ago In my more successful sales where I have adhered to your principles, the prospect never brings up a question about signing a nondisclosure agreement (NDA). I don't usually mention it either. It seems to slow the process down. Sometimes when we do business and sign agreements we include it at the end realizing we never signed one in the very beginning. Especially when my HQ realizes it. Sometimes when determining conditions of satisfaction we sign a NDA at that point realizing we are getting into some business or technical details that they feel more comfortable with an NDA. And others, when agreeing to an hour of uninterrupted time, ask that an NDA be signed. In those situations, should I request that our mutual NDA be used or should I use theirs? All other things being equal, does it make a difference whether we use theirs or ours? |

| Posted 6 months ago From what I understand, both should be signed, for the security of everyone involved. Yet, if at least one is signed, that will hold up as a binding agreement between both parties. If you only sign theirs, however, be sure the statues cover your ass, too. |
